The creators who upload their Content to Envatomart retain the copyright and intellectual property rights to their work unless otherwise specified. By uploading Content to Envatomart, authors grant Envatomart a license to display, distribute, and sell their Content on the platform, subject to the terms and conditions of our marketplace.

Users who purchase or download Content from Envatomart are granted a non-exclusive, non-transferable license to use the Content as permitted under the license agreement. The license does not transfer ownership of the Content, and users are prohibited from infringing on the intellectual property rights of the creators.

3. Copyright Infringement Claims

If you believe that your copyright-protected work has been uploaded or made available on Envatomart without your permission, you may submit a claim for copyright infringement. Envatomart will respond to all valid infringement notices in accordance with the Digital Millennium Copyright Act (DMCA) or any other applicable copyright laws.

To submit a claim, please provide the following information:

A description of the copyrighted work that you believe has been infringed.
A description of where the infringing Content is located on Envatomart (including URLs).
Your name, contact information, and a statement confirming that you are the copyright owner or authorized to act on behalf of the copyright owner.
A statement that you have a good faith belief that the use of the Content is not authorized by the copyright owner, their agent, or the law.
A statement, under penalty of perjury, that the information provided is accurate and that you are the copyright owner or authorized to act on their behalf.

Once we receive a valid notice, we will promptly investigate the claim and take appropriate action. If the claim is found to be valid, we will remove or disable access to the infringing Content.

4. Counter-Notification

If you believe that your Content was removed or disabled due to an error or misidentification, you may submit a counter-notification. To submit a counter-notification, you must provide the following:

Your name, contact information, and a statement that you have a good faith belief that the Content was removed or disabled due to a mistake or misidentification.
A description of the Content that was removed or disabled, including the location (URL) where it appeared prior to removal.
A statement under penalty of perjury that you consent to the jurisdiction of the court in your location and will accept service of process from the party that submitted the original infringement notice.

Once we receive a valid counter-notification, we will forward it to the original copyright claimant and restore the Content unless we receive notice that legal action has been initiated to prevent the restoration.

5. Repeat Infringers

Envatomart maintains a policy of terminating accounts of users who are determined to be repeat infringers. If a user is found to be repeatedly infringing on the intellectual property rights of others, their account may be suspended or permanently banned from our platform.

6. Fair Use

We recognize that certain uses of copyrighted Content may be considered "fair use" under copyright law. However, it is the responsibility of the user to ensure that their use of Content falls within the boundaries of fair use. Envatomart does not endorse or guarantee that any use of Content on the platform constitutes fair use.
